1. About These Terms

These Terms and Conditions (“Terms”) govern your use of the Marcus Neal Fitness platform (“the Platform”, “the Service”), operated by Marcus Neal (“the Coach”, “we”, “us”). The platform is developed and maintained by Crystallized Intelligence S.a r.l., an AI consultancy based in Luxembourg.

By creating an account and using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. The Service

Marcus Neal Fitness provides a custom fitness coaching platform that includes:

  • AI-generated weekly workout plans tailored to your profile, goals, and preferences
  • Real-time workout modification based on how you feel on a given day
  • An exercise library with video demonstrations
  • Macro tracking tools (screenshot upload and manual entry)
  • A community leaderboard (opt-in)
  • Workout of the Week content curated by your coach

3. Account Registration

To use the Platform, you must create an account and complete the intake form. You agree to:

  • Provide accurate and up-to-date information about yourself, including any relevant health information
  • Keep your login credentials secure and not share them with others
  • Notify us promptly if you become aware of any unauthorised use of your account

You are responsible for all activity that occurs under your account.

4. Health & Safety Disclaimer

Important: Marcus Neal Fitness is a fitness coaching service, not a medical service. The workout plans generated by the Platform — whether created by the Coach or by AI — do not constitute medical advice. You should consult a qualified healthcare professional before beginning any new exercise programme, particularly if you have pre-existing health conditions, injuries, or are pregnant or postpartum.

By using the Platform, you acknowledge and agree that:

  • You participate in all exercises at your own risk
  • You are responsible for honestly disclosing any injuries, health conditions, or limitations in your profile and pre-workout check-ins
  • The Coach and the Platform operator are not liable for any injury, illness, or adverse effect resulting from following a workout plan
  • AI-generated workout modifications are based on the information you provide; incomplete or inaccurate information may lead to unsuitable exercises
  • You should stop exercising immediately and seek medical attention if you feel pain, dizziness, or discomfort during a workout

5. AI-Generated Content

Workout plans on this Platform are generated using artificial intelligence (Mistral AI) based on your personal profile, the Coach's training methodology, and a curated exercise library. You acknowledge that:

  • AI-generated plans are tools to support your training, not a replacement for professional judgment
  • Plans may occasionally contain errors, and you should use your own judgment when following them
  • You can report any issue with a workout at any time, and a regenerated plan will be provided
  • The Coach reviews overall platform output and methodology but may not individually review every generated plan

6. Macro Tracking

The macro tracking feature allows you to upload screenshots from nutrition tracking apps or manually enter your daily macro intake. You agree that:

  • Screenshots you upload will be processed by AI (optical character recognition) to extract nutritional data
  • We do not guarantee 100% accuracy of OCR-extracted values; you should verify important figures
  • Macro targets provided through the Platform are general guidance and do not constitute nutritional or dietetic advice

7. Leaderboard

The Platform features an opt-in leaderboard that displays participants' first names and engagement scores. If you opt in, your first name and score will be visible to other clients. You may opt out at any time by updating your preferences or contacting us.

8. Payment

Access to Marcus Neal Fitness requires a paid subscription. Payment terms are as follows:

  • Subscription fees are billed monthly via Revolut Pay using SEPA or another accepted payment method
  • By providing your payment details, you authorise recurring monthly charges
  • SEPA Direct Debit payments may take up to 14 business days to process; your access will not be interrupted during this processing period
  • Prices may change with 30 days' notice sent to your registered email address

9. Cancellation & Refunds

  • You may cancel your subscription at any time by contacting us at info@marcusnealfitness.com
  • Cancellation takes effect at the end of your current billing period; you will retain access until then
  • Refunds are handled on a case-by-case basis at the Coach's discretion
  • Upon cancellation, your data will be retained for 30 days in case you wish to reactivate, after which it will be deleted in accordance with our Privacy Policy

10. Acceptable Use

You agree not to:

  • Share your account credentials or workout plans with non-subscribers
  • Attempt to reverse-engineer, interfere with, or exploit the Platform's AI systems or APIs
  • Submit false, misleading, or malicious information through any form or input field
  • Use the Platform for any unlawful purpose
  • Attempt to inject prompts or manipulate AI outputs through the pre-workout check-in or other free-text fields

11. Intellectual Property

All content on the Platform — including workout methodologies, exercise videos, the exercise library, branding, and software — is the property of Marcus Neal Fitness and/or Crystallized Intelligence S.a r.l. You may not reproduce, distribute, or create derivative works from this content without written permission.

Your personal workout plans are generated for your personal use only and may not be resold or redistributed.

12. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Platform is provided “as is” without warranties of any kind, express or implied
  • We do not warrant that the Platform will be available at all times, error-free, or that AI-generated content will be perfectly suited to your needs
  • Our total liability to you for any claim arising from your use of the Platform shall not exceed the total fees you have paid to us in the 3 months preceding the claim
  • We are not liable for any indirect, incidental, or consequential damages

13. Termination

We may suspend or terminate your account if you breach these Terms, engage in abusive behaviour, or if we reasonably believe your continued use poses a risk to yourself or others. In such cases, we will notify you via email and explain the reason.

14. Governing Law & Disputes

These Terms are governed by the laws of Luxembourg. Any dispute arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Luxembourg, without prejudice to any mandatory consumer protection provisions that may apply in your country of residence under EU law.

15. Changes to These Terms

We may update these Terms from time to time. When we make changes, we will update the “Last updated” date at the top of this page and notify you by email or through the Platform. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
